The United States and Guatemala Forge New Trade Framework
The United States of America (U.S.) and the Republic of Guatemala have embarked on a new chapter of their economic partnership by agreeing on a Framework for an Agreement on Reciprocal Trade (Agreement). This initiative aims to enhance their longstanding economic ties, particularly building upon the Dominican Republic-Central America-United States Free Trade Agreement (CAFTA-DR), which took effect for both nations back in 2006.
Key Components of the Reciprocal Trade Agreement
- Guatemala has pledged to tackle various non-tariff barriers that impede trade in critical sectors. This includes simplifying regulatory requirements for U.S. exports, particularly in pharmaceuticals and medical devices, lifting import restrictions on remanufactured goods, aligning with U.S. automotive standards, and expediting product registration processes by accepting electronic certificates and eliminating unnecessary documentation requirements.
- To enhance access for U.S. agricultural products, Guatemala has also committed to addressing barriers related to regulatory oversight and accepting certificates issued by U.S. authorities. The country promises to uphold science-based regulatory practices and efficient approval processes for agricultural imports.
- Intellectual property (IP) protection is another focal point, with Guatemala agreeing to strengthen its IP laws and fully implement international treaties, thereby addressing longstanding issues highlighted in the Office of the United States Trade Representative’s Special 301 Report.
- In a move aimed at ensuring fair competition, Guatemala has committed to transparency regarding geographical indications, ensuring that the mere mention of certain cheese and meat terms won’t restrict market access.
- On the digital trade front, Guatemala has vowed to avoid imposing discriminatory taxes on U.S. digital services and products while ensuring the free flow of data across borders. Furthermore, it supports a permanent moratorium on customs duties for electronic transmissions at the World Trade Organization (WTO).
- Guatemala has also agreed to take effective actions to implement the Joint Initiative on Services Domestic Regulation, which will facilitate smoother trade in services.
- To further streamline trade processes, Guatemala intends to adopt best practices in customs and implement sound regulatory measures.
- Labor rights are another key commitment, as Guatemala has agreed to uphold internationally recognized labor standards by prohibiting the importation of goods made with forced labor and enhancing labor laws and enforcement mechanisms.
- Environmental protections are also on the agenda, with Guatemala committing to robust enforcement of environmental laws and taking measures to combat illegal logging, wildlife trafficking, and illegal mining, while also pledging to adhere to the WTO Agreement on Fisheries Subsidies.
- Addressing state-owned enterprises and industrial subsidies that might distort trade relations is another area Guatemala has committed to improving.
- Lastly, the Agreement includes measures to bolster economic and national security cooperation, enhancing supply chain resilience and innovation while tackling non-market policies from other countries and ensuring investment security.
- Guatemala has also agreed to restrict access to central-level procurement that falls under its free trade commitments for suppliers outside of free trade agreement partners, aligning its practices with those of the United States.
Looking Ahead
In the weeks to come, both nations will finalize the Agreement, preparing it for signature and completing necessary domestic procedures before it officially comes into force. Reflecting Guatemala’s commitment to fostering a balanced trade relationship, the United States will lift reciprocal tariffs on certain Guatemalan exports that cannot be sufficiently produced domestically, including textiles and apparel originating under CAFTA-DR. The U.S. and Guatemala are optimistic about finalizing this Agreement promptly.
