Dave Erickson Sues AMC Networks Over Profit Dispute

Dave Erickson, co-creator of “Fear the Walking Dead,” has filed a lawsuit against AMC Networks, claiming he has been unfairly denied his rightful share of the show’s profits. This makes him the seventh producer associated with “The Walking Dead” franchise to accuse the cable network of using questionable accounting practices to avoid paying out profits.

Erickson, who co-created the spinoff series in 2015 alongside Robert Kirkman, the original comic series creator, also served as the showrunner for three years. In the lawsuit, it is alleged that despite the show’s success, Erickson has not received any profits, while others have reportedly received up to $67 million. The network claims that the show is operating at a $185 million deficit, making it unlikely that Erickson will ever see any profit payments.

Like previous lawsuits related to “The Walking Dead,” the complaint accuses AMC of manipulating financial figures to avoid profit distributions. The lawsuit claims that AMC, as both producer and distributor of the show, has exploited its position to inflate expenses and diminish profits owed to participants.

According to the lawsuit, Erickson is seeking to address AMC’s alleged misconduct and secure the tens of millions of dollars he believes he is rightfully owed. The legal action mirrors previous disputes within the franchise, including a $200 million settlement with Frank Darabont in 2021 and ongoing litigation with Kirkman and other producers.

AMC has refuted Erickson’s claims, with the company’s attorney, Orin Snyder, dismissing the lawsuit as baseless. Snyder asserts that the contracts were negotiated by experienced legal professionals and that AMC has fulfilled its financial obligations. He characterizes the lawsuit as a money grab without merit.

Erickson’s lawsuit contends that he was promised 5% of the “modified adjusted gross receipts” from “Fear the Walking Dead” under his overall deal with AMC. However, it was only later revealed that the show was operating at a significant deficit, leading Erickson to question the fairness of the financial arrangement.

The legal battle between Dave Erickson and AMC Networks highlights the ongoing challenges faced by content creators in navigating profit-sharing agreements within the entertainment industry. As the dispute unfolds, the outcome will likely have implications for future collaborations between producers and networks.
