A University of Otago student, Joe James Skeggs-O’Donnell, who was involved in a violent incident at a nightclub has successfully appealed for a discharge without conviction, allowing him to pursue a career as a chartered accountant.

Skeggs-O’Donnell pleaded guilty to wounding with intent to injure after he bottled a man in the nightclub in March 2023. Despite his initial application for a discharge without conviction being rejected, he filed an appeal with the High Court, which was heard and granted last month.

The incident occurred when Skeggs-O’Donnell, then 19 years old, got into a physical altercation with a man in a nightclub after a brief interaction. CCTV footage showed him hitting the man with a bottle and attempting to punch him. The victim suffered visible scars to his forehead and chin as a result.

Following the appeal, Justice Peter Andrew discharged Skeggs-O’Donnell without conviction, noting that he had shown significant maturity and progress in his academic pursuits. Affidavits from recruitment specialists highlighted the potential negative impact of a conviction on his career prospects in the accounting field.

Despite the delay in filing the appeal, Justice Andrew emphasized the importance of considering the long-term implications for young individuals like Skeggs-O’Donnell. With a promising future and a low risk of reoffending, he was granted the opportunity to move forward without the burden of a criminal record.

Overall, the successful appeal has opened up new opportunities for Skeggs-O’Donnell to pursue his academic goals and achieve his aspirations of becoming a chartered accountant.
