X.AI has filed a lawsuit challenging a Minnesota law, claiming it imposes a broad and content-specific restriction on free speech by attempting to ban ‘nudification.’ The company stated that it already enforces strict policies against users who create nude or sexualized images of individuals without their consent.

X.AI contends that while Minnesota might have a valid interest in stopping the non-consensual creation and distribution of nude images, the law unfairly targets AI platforms by hindering the creation of a significant amount of lawful content.

Set to take effect on Saturday, the law enables victims to pursue legal action against the operators of nudification apps for compensation. Additionally, it authorizes the state attorney general to impose fines of $500,000 per violation.

Minnesota Attorney General Keith Ellison expressed strong criticism of AI-generated nude images without consent, labeling it as appalling. He emphasized that while AI presents many valuable discussion points, this issue is not one of them, as AI nudification strips individuals of their dignity and can cause substantial harm. In response to the lawsuit, Ellison stated, “I’ll see X in court.”
