President’s Order on Addressing Threat from Canada

On February 1, 2025, the President of the United States invoked his authority under various laws to address the threat posed by Canada’s failure to intercept drug trafficking organizations, human traffickers, and criminals at large. This threat was deemed to be an unusual and extraordinary threat to the national security, foreign policy, and economy of the United States. To combat this threat, ad valorem tariffs were imposed on products from Canada.

Immediate Steps Taken

Following the imposition of tariffs, the Government of Canada took immediate steps to alleviate the crisis caused by illegal migration and illicit drugs. However, more time was needed to assess whether these steps were sufficient to address the threat from Canada. A pause was implemented to evaluate the situation and determine if the threat had abated.

Pause in Tariff Implementation

The additional ad valorem rates of duty and energy product rates of duty were paused and would not take effect until March 4, 2025. During this pause, various government agencies would continue to assess the situation at the northern border. If the crises worsened and Canada failed to take sufficient steps to address them, the President would implement necessary measures, including immediate tariff implementation.

Severability and General Provisions

The order includes provisions for severability, ensuring that if any part of the order is deemed invalid, the remainder would still be effective. It also clarifies that the order does not affect the authority of executive departments or agencies and is subject to applicable laws and appropriations. The order does not create any rights or benefits enforceable against the United States or its entities.

Conclusion

The President’s order on addressing the threat from Canada highlights the government’s commitment to combating illegal activities that pose a threat to national security. By imposing tariffs and evaluating the effectiveness of Canada’s actions, the administration aims to protect the country from external threats. Stay tuned for further updates on this developing situation.
