In a lawsuit filed on Friday, the Democratic National Committee and congressional Democrats’ campaign arms argue that Trump’s recent executive order, which asserts control over all independent agencies within the Executive Branch, could lead to the FEC being used as a political weapon against Trump’s opponents, rather than ensuring fair and impartial oversight of campaign finances.

Specifically, Democrats point to a provision in the executive order that mandates all executive branch officials to defer to Trump’s interpretation of the law, rather than exercising their own independent judgment. This directive, they argue, could replace the FEC’s bipartisan decision-making process with the unilateral judgment of a partisan political figure – the President of the United States. Democrats are seeking legal intervention to affirm the FEC’s constitutional independence from the president and to block the Trump administration from applying the executive order to the agency.

The lawsuit filed by Democrats represents a proactive effort to preserve the integrity of the FEC and uphold the principles of fair and transparent campaign finance regulation. As the legal battle unfolds, the outcome will have significant implications for the balance of power between the executive branch and independent agencies, as well as the broader landscape of campaign finance oversight in the United States.
