The lawsuit reveals that Officer Byrd had a track record of failing to meet firearm qualification requirements and leaving his loaded weapon unattended in a public area. He also reportedly fired his weapon at a stolen vehicle, causing damage to nearby homes. Additionally, his peers noted that he was not a skilled marksman.

The filing also states that Officer Byrd admitted to shooting Ashli Babbitt without assessing her intentions or identifying her as unarmed. Micki Witthoeft, Ashli Babbitt’s mother, highlighted the lack of oversight within the Capitol Police Department and their failure to report incidents. She shared an anecdote about having to wake up a sleeping officer to access a building, emphasizing the department’s negligence.

After years of legal proceedings, the Trump Administration has signaled its intention to resolve the case for the Babbitt family. The parties involved have agreed to work towards narrowing or resolving the issues in the lawsuit.
