A mistrial has been declared in the case of Southern California Judge Jeffrey Ferguson, who was accused of fatally shooting his wife in 2023 after more than a week of deliberations.

A Los Angeles Superior Court made the ruling Monday when one of the twelve jurors did not find Ferguson guilty of murdering his wife, Sheryl Ferguson, leading to an 11-1 deadlock, according to reports.

Orange County District Attorney Todd Spitzer stated that prosecutors are prepared to retry the case, highlighting the significant 11-1 majority in favor of guilt.

Following the ruling, members of the District Attorney’s office are planning to meet with Sheryl Ferguson’s family to discuss the next steps in seeking justice for her death.

Sheryl Ferguson’s brother, Larry Rosen, expressed satisfaction with the outcome, believing that the shooting was an accident rather than premeditated murder.

Jeffrey Ferguson’s defense attorney, Cameron Talley, expressed hope that prosecutors would not pursue a retrial considering the judge’s age and emphasized that the evidence did not support the intent to kill.

Ferguson, 74, was accused of shooting his wife at their Anaheim Hills home in Orange County on August 3, 2023, following a heated argument that escalated after a family dinner.

The couple’s argument continued at home, where Ferguson fatally shot his wife during a confrontation, with their adult son present in the house.

Following the shooting, Ferguson contacted emergency services and also messaged his court clerk and bailiff, admitting to the incident and expressing remorse.

Investigators discovered multiple firearms and ammunition inside the couple’s residence, leading to Ferguson’s arrest and subsequent release on bail.

During the trial, Ferguson maintained that the shooting was accidental and expressed regret over the tragic incident.

Prosecutors argued that Ferguson, under the influence of alcohol, used a concealed weapon to intentionally shoot his wife during the argument, leading to her death.

Ferguson’s blood-alcohol level was a key point of contention during the trial, with expert testimony suggesting he was significantly impaired at the time of the shooting.

The case has garnered significant attention due to Ferguson’s position as a judge and the tragic circumstances surrounding his wife’s death.

The outcome of the mistrial has left both parties with mixed emotions, with the possibility of a retrial looming as prosecutors seek to bring closure to the case and deliver justice for Sheryl Ferguson.
