In a notable exchange, Senator Marco Rubio addressed left-leaning reporters’ inquiries concerning the Biden Administration’s purported attempts to facilitate the return of Kilmar Garcia Abrego, a deported MS-13 member.
“I would never disclose that to you, nor would I to a judge,” Rubio retorted, criticizing the judiciary for what he perceives as overreach in foreign policy matters.
This development follows a recent ruling by the US Supreme Court, which has mandated the government to assist in the return of Abrego Garcia, siding with District Court Judge Paula Xinis’s earlier decisions.
Abrego Garcia was initially shielded from deportation in 2019 due to safety concerns but was ultimately expelled under the Alien Enemies Act in 2025.
As noted by , the Trump Administration’s Department of Justice previously contended that federal courts lack the authority to dictate how the Executive Branch manages foreign relations or to compel the return of individuals from foreign nations. They argued that should Garcia Abrego return, he would simply face deportation again for his illegal status.
During a recent cabinet meeting, Rubio firmly stated, “The conduct of our foreign policy is the responsibility of the President of the United States and the Executive Branch, not some judge,” affirming their stance against judicial interference.
Defense Secretary Pete Hegseth was visibly amused by the reporter’s inquiry, highlighting the often absurd nature of political questioning.

Rubio: I would never reveal that, and you know who else I wouldn’t tell? A judge. The conduct of our foreign policy belongs to the President of the United States and the Executive Branch, not some judge. We will handle foreign policy appropriately if necessary, but I won’t discuss it, and no one will compel us to do so because that’s how foreign policy operates.
In a similar vein, President Trump recently confronted CNN’s Kaitlan Collins during a press conference, dismissing her question about whether they would solicit help from El Salvador’s President Nayib Bukele to facilitate the return of the alleged gang member.
Rubio reiterated during this exchange, “The foreign policy of the United States is directed by the President, not the courts, and no court has the authority to dictate how we conduct our foreign affairs.”
