Woolworths NZ facing charges over pricing and ‘specials’

The Commerce Commission has taken legal action against Woolworths NZ for allegedly misleading pricing and inaccurate specials that may have violated the Fair Trading Act.

The charges were filed in the Auckland District Court by the Commission. This action follows the Commission’s statement last December about potential breaches of the Fair Trading Act by Woolworths and two Pak’nSave supermarkets due to pricing issues in the supermarket sector.

Deputy Chair Anne Callinan emphasized the importance of accurate and transparent pricing, stating that supermarket operators should be aware of consumer expectations. She expressed dissatisfaction with the recurring pricing issues in the industry and reminded supermarkets of their responsibility to adhere to pricing regulations.

Callinan stressed that pricing accuracy is a consumer right and a fundamental aspect of a competitive market. She urged supermarkets to invest time and resources in ensuring pricing and promotions are correct.

Woolworths Managing Director Spencer Sonn acknowledged the importance of customers trusting advertised prices at their supermarkets, while also acknowledging that errors can occur. Woolworths stated that they have been cooperating with the Commerce Commission’s pricing investigation.

The charges serve as a reminder to all supermarkets to address pricing accuracy issues and implement improved processes, according to Callinan. The Commission’s actions aim to uphold consumer rights and maintain a fair and competitive market environment.
