Denver’s Waste Recycling and Composting Mandate Faces Implementation Challenges

Despite Denver voters approving an initiative requiring more recycling and composting in apartment buildings and restaurants two and a half years ago, the city is facing obstacles in implementing the mandate. City officials have proposed ordinance updates to kickstart enforcement, but concerns have been raised about the potential exemptions that could undermine the original intent of the initiative.

The City Council committee has decided to delay a vote on advancing the changes to ensure they align with the voters’ expectations. The city has been working to formalize the requirements since they were approved in November 2022, with the latest proposed changes aiming to balance environmental goals with business interests.

According to Jonathan Wachtel from the Denver Office of Climate Action, Sustainability, and Resiliency, Mayor’s focus is on creating a city that is both environmentally friendly and business-friendly, without compromising either aspect. However, environmental advocacy group GreenLatinos, the driving force behind the “Waste No More” measure, believes that the proposed changes do not fully reflect the voters’ desires.

While the voter-approved ordinance mandates recycling and composting services in apartments, restaurants, commercial buildings, and events, the proposed exemptions in the updated rules are causing concerns. The enforcement, initially scheduled to roll out in phases, is now set to begin in April 2026.

Key points of contention include exemptions for small restaurants and construction sites, as well as challenges in multifamily residential buildings. GreenLatinos argue that these exemptions deviate from the original intent of the initiative.

The city’s recommended guidelines propose fines for non-compliance and an education-first approach to enforcement. Entities that face financial burdens in meeting the requirements can apply for individual exemptions. GreenLatinos are set to discuss their concerns with council members ahead of the upcoming committee meeting.
