In a groundbreaking legal decision, a court has affirmed what many had long suspected: Donald Trump’s tariffs were not only questionable but illegal. For the first time, the judiciary has ruled that Trump lacked the emergency powers necessary to impose these tariffs at his discretion. As a result, the tariffs have been blocked, and the court suggests that any funds collected under these dubious charges may need to be refunded.


The court’s ruling stated:

The Constitution clearly designates Congress with the exclusive powers to “lay and collect Taxes, Duties, Imposts and Excises,” and to “regulate Commerce with foreign Nations.” U.S. Const. art. I, § 8, cls. 1, 3. The central issue in the cases under review is whether the International Emergency Economic Powers Act of 1977 (IEEPA) grants the President authority to impose unlimited tariffs on imports from almost every country. The court interprets IEEPA as not conferring such unrestricted powers and thus invalidates the tariffs in question.

The court concludes that IEEPA does not grant authorization for the Worldwide, Retaliatory, or Trafficking Tariff Orders. The imposed Worldwide and Retaliatory Tariff Orders exceed any authority that IEEPA provides to the President regarding tariff regulations. Furthermore, the Trafficking Tariffs fail to address the threats outlined in those orders. Consequently, the plaintiffs are entitled to a legal judgment; since there is no material fact in dispute, summary judgment will be issued against the United States.

Refer to USCIT R. 56. The contested Tariff Orders will be annulled, and their enforcement permanently restrained.

The court’s decision is unequivocal: Trump’s tariff actions are illegal, and the tariffs themselves are effectively rendered null and void.
