Justice Department Launches Criminal Investigation into Andrew Cuomo’s Testimony

The Justice Department has initiated a criminal investigation into Andrew Cuomo, the former governor of New York and a current frontrunner in the NYC mayoral race, concerning his statements about nursing home fatalities during the Covid pandemic.

Last month, House Oversight Chairman James Comer (R-KY) resubmitted a criminal referral to Attorney General Pam Bondi, urging the DOJ to consider charges against Cuomo for allegedly lying under oath amid investigations related to the pandemic.

The letter, directed to AG Pam Bondi, accuses Cuomo of contravening 18 U.S.C. §1001, a federal law that prohibits making false statements to Congress:

On October 30, 2024, the Select Subcommittee on the Coronavirus Pandemic referred former New York Governor Andrew M. Cuomo for allegedly making criminally false statements in violation of 18 U.S.C. §1001.1

To our knowledge, the Biden Administration has overlooked this referral notwithstanding the compelling facts and evidence. Therefore, we request you to evaluate this referral and take appropriate action. For your convenience, the referral is attached to this correspondence.

The Committee on Oversight and Government Reform serves as the primary oversight body of the U.S. House of Representatives, endowed with the authority to investigate “any matter” at “any time” under House Rule X.

Throughout 2020, various reports highlighted how Governor Cuomo’s policies mandated the re-admission of COVID-positive patients into nursing homes, leading to the tragic loss of thousands of elderly residents in New York.

When the Department of Justice requested official counts of nursing home deaths, the figures provided were significantly lower than the actual numbers, reportedly by about 50%.

Although an investigation into Cuomo’s actions was launched, he ultimately resigned from the governorship. However, the inquiries into the alleged illegal activities related to the nursing home deaths were subsequently dropped by both the Biden DOJ and the Manhattan District Attorney.

“Andrew Cuomo embodies a legacy of corruption and deceit, now caught in the act of lying to Congress during the Select Subcommittee’s investigation into the COVID-19 nursing home crisis in New York,” stated Chairman Comer.

According to The New York Times, Cuomo is currently under investigation by the DC US Attorney’s Office.

This investigation commenced last month under Acting DC US Attorney Ed Martin and is now being overseen by interim DC US Attorney Jeanine Pirro.
