Data also revealed that nearly 20% of individuals arrested for felonies in Chicago were already on pretrial release for another pending criminal case.

Contrary to expectations that the Pretrial Fairness Act would reduce jail populations, Kenneally reported a rise in the number of individuals incarcerated in McHenry County Jail since the implementation of the law. He highlighted a 280% increase in criminal defendants failing to appear for their hearings, leading to challenges in enforcing victim compensation.

Proponents of the law, such as the Illinois Network for Pretrial Fairness, disputed Kenneally’s claims, stating that his analysis used percentages to exaggerate data. They argued that the system of basing pretrial release decisions on public safety rather than wealth is effective and highlighted a decrease in Failure to Appear Warrants in McHenry County.

However, concerns have been raised about the accuracy of reported compliance rates under the new system. Clerk of the Circuit Court of Cook County Iris Martinez revealed that over 70% of defendants failed to appear for court dates during the initial period of cashless bail implementation.
