A federal appeals court in Washington denied the Trump administration’s request to resume deporting Venezuelan migrants to El Salvador under an old wartime law. The U.S. Court of Appeals for the District of Columbia Circuit upheld a temporary ban on deportations under the Alien Enemies Act of 1798.

President Trump’s administration used the law for the first time since World War II to deport individuals linked to the Tren de Aragua gang, considering them as an invading force. However, U.S. District Judge James Boasberg intervened, preventing further deportations and ordering some immigrants to return to the U.S.

The lawsuit was filed by the ACLU on behalf of five Venezuelan noncitizens detained in Texas, adding to the ongoing tensions between the White House and the judiciary.
