Dan Schneider Loses 'Quiet on Set' Defamation Suit on Appeal

The producers of the documentary series “Quiet on Set” have won a legal battle against Dan Schneider, a former showrunner at Nickelodeon, who accused the series of suggesting he was involved in child sexual abuse.

In 2024, Schneider filed a defamation lawsuit, asserting that the documentary falsely implied he was responsible for or enabled sexual abuse by others. Initially, he succeeded in court when a judge acknowledged the validity of his claims and refused to dismiss the case.

However, Warner Bros. Discovery, Sony, and producers Mary Robertson and Emma Schwartz appealed the decision. On Thursday, a three-judge panel unanimously sided with them. The judges determined that while the series portrays Schneider as a poor manager, it does not suggest he engaged in child sexual abuse.

Judge Melanie Ochoa, writing for the panel, stated, “The documentary clearly separates Schneider’s alleged conduct—such as gender discrimination, harassment, and inappropriate sexual innuendo—from the child sexual abuse attributed to three other individuals, two of whom are discussed in detail. ‘Quiet on Set’ also clarifies that Schneider’s employer investigated his behavior and found no evidence of child sexual abuse despite confirming some inappropriate actions. Schneider’s effort to interpret the documentary differently than stated is unfounded.”

Schneider was instrumental in creating popular Nickelodeon shows like “The Amanda Show,” “Drake & Josh,” “Zoey 101,” “iCarly,” and “Victorious.” In 2018, Nickelodeon severed ties with him due to allegations of abusive conduct.

The series, titled “Quiet on Set: The Dark Side of Kids TV,” aired on Investigation Discovery in March 2024. Following its release, Schneider issued a video apology, expressing embarrassment over his past behavior.

In the lawsuit, Schneider’s legal team argued that although the show did not directly accuse Schneider of sexual abuse, it juxtaposed accusations of “inappropriate behavior” with images of him with young actresses.

The documentary also covered cases involving Brian Peck, a dialogue coach arrested for child sexual abuse, and Jason Michael Handy, a production assistant accused of sending an explicit photo to a child actress.

Schneider maintained that he was not involved in these cases and claimed the series falsely linked him to them.

Nevertheless, the panel concluded that this argument was untenable since the documentary explicitly attributes the abuse to named perpetrators and confirms that an investigation into Schneider found no evidence of abuse.

The defendants succeeded under California’s anti-SLAPP statute, which provides a mechanism to dismiss lawsuits aimed at suppressing speech on public interest topics.

Gerry Silver, Schneider’s attorney, expressed disappointment with the outcome.

“We are disappointed by the Court’s decision to reverse the Superior Court’s well-reasoned anti-SLAPP ruling, and we are evaluating our options for further review and appeal,” Silver stated. “However, we are pleased that the Court acknowledged that the makers of ‘Quiet on Set’ presented absolutely no evidence that Dan was sexually abusive towards any of his cast members and agreed that any such allegation is provably false.”
