Judge Steven Hippler overseeing Bryan Kohberger’s quadruple-murder trial in Boise, Idaho, is determined to identify and hold accountable anyone who may have violated the gag order by leaking information from the investigation to unauthorized sources. He has instructed both prosecutors and defense attorneys to provide a list of all individuals, including staff members, law enforcement officers, and defense consultants, who had access to the undisclosed details featured in a recent NBC “Dateline” episode that aired on May 9.

The leaked information pertains to Kohberger’s internet search history and other crucial details related to the case. The judge expressed his willingness to appoint a special prosecutor to investigate the leak, which is believed to have breached the gag order in place since 2023. The breach could potentially impact the jury selection process, prolonging the already complex trial and increasing costs for taxpayers.

Bryan Kohberger, a 30-year-old former graduate student at Washington State University, stands accused of fatally stabbing University of Idaho students Ethan Chapin, Xana Kernodle, Madison Mogen, and Kaylee Goncalves in a rental home near the campus in Moscow, Idaho, on November 13, 2022. A not-guilty plea has been entered on his behalf, and the trial is scheduled to commence in August, with prosecutors indicating their intent to seek the death penalty if Kohberger is convicted.

Judge Hippler highlighted in court documents his concern over the potential bias introduced by the leak, making it challenging to ensure a fair trial for both the prosecution and defense. He emphasized the importance of identifying the source of the leak to uphold the integrity of the legal process.

Additionally, Hippler instructed all individuals involved in the case to preserve any records of their communications with journalists or external parties regarding Kohberger or the investigation. As the case unfolds, Hippler expects the attorneys to formally request an investigation into the breach of the gag order. The judge’s proactive stance underscores the significance of upholding legal procedures and ensuring a fair trial for all parties involved in this high-profile quadruple-murder case.
