A statement from the House Judiciary Committee Democrats reads:
Rep. Jamie Raskin, who serves as the Ranking Member of the House Judiciary Committee, has introduced a bill to create a Commission on Presidential Capacity to Discharge the Powers and Duties of Office. This body, as described in Section 4 of the 25th Amendment to the U.S. Constitution, is intended to ensure consistent and effective leadership in the presidency. It functions as a legislative counterpart to the Cabinet, working alongside the Vice President. The 25th Amendment provides a constitutional solution for any potential medical crisis that may arise.
Section 4 of the 25th Amendment allows Congress to form a permanent “body” that, with the Vice President’s agreement, can declare the President incapable of executing the powers and duties of the office. Although the amendment was established over 50 years ago, such a body was never created. Raskin’s legislation proposes the creation of this independent nonpartisan body: The Commission on Presidential Capacity to Discharge the Powers and Duties of Office. This enables the Vice President to act with either a majority of the Cabinet or this new body during a 25th Amendment crisis.
In emergencies, Congress might pass a concurrent resolution demanding the Commission to assess the President’s capability to perform official duties and report its findings to Congress. If the President is deemed incapacitated by the Vice President and a majority of the Commission, the Vice President would assume the role of Acting President immediately.
The proposed legislation holds significant importance.
