Luigi Mangione Files Motion to Dismiss Death Penalty Indictment

Luigi Mangione‘s legal team is fighting against what they claim to be an unconstitutional death penalty case in connection with the murder of UnitedHealthcare CEO Brian Thompson. They are urging the judge to dismiss the indictment, citing intentional violations of Luigi’s rights by law enforcement officials.

In court documents, Luigi’s attorneys, Karen Friedman Agnifilo, Marc Agnifilo, and Jacob Kaplan, allege that his rights were repeatedly violated by the NYPD and federal government to secure the death penalty. They argue that the indictment is unconstitutional and should be invalidated.

The defense team highlights instances where Luigi’s rights were violated, including the leaking of information by the NYPD and the staging of a controversial “perp walk” by the FBI and NYPD. They argue that these actions were meant to prejudice the case and strip Luigi of a fair trial.

The defense further accuses government officials of assuming Luigi’s guilt and engaging in prejudicial rhetoric, as exemplified by statements made by Attorney General Pam Bondi. These actions, according to Luigi’s legal team, deprived him of a fair grand jury process.

The motion to dismiss the indictment comes shortly after Luigi had two state terrorism charges against him dropped in a New York court, marking a significant legal victory for his defense team.
