DEFENDING AMERICAN WORKERS AND ENSURING FAIR TRADE: President Donald J. Trump has enacted three Proclamations under Section 338 of the Tariff Act of 1930, introducing additional 50% tariffs on select Canadian goods. This measure responds to what is seen as Canada’s discriminatory practices against American products. By implementing these tariffs, President Trump aims to mitigate the burden on U.S. commerce and create a more equitable trading environment for key American exports, including cars, alcohol, and dairy.

  • The proclamations under Section 338 enact a 50% tariff on distinct categories of Canadian imports, which include items like wine, hockey sticks, and cement.
  • These tariffs apply to all listed goods irrespective of their origin under the U.S.-Mexico-Canada Agreement (USMCA).
  • However, the tariffs exclude energy, potash, products already subject to Section 232 tariffs, and certain other items such as fish or critical minerals.

SECURING FAIR TREATMENT FOR AMERICAN EXPORTS: President Trump is moving to hold Canada accountable for its ongoing discriminatory actions and unequal treatment of U.S. commerce, which have adversely affected American workers.

  • Section 338 grants the President authority to impose tariffs when U.S. exporters face disadvantages compared to exports from other countries, aiming to alleviate the burden on U.S. commerce.
  • Canada enforces specific tariffs and quotas on U.S. car imports, different from other countries, pressuring U.S. auto manufacturers to invest in Canadian production rather than in the United States.

    • Between April 2025 and March 2026, there was a 22% decrease in Canadian imports of U.S. motor vehicles, amounting to $5.6 billion less than the previous year. Meanwhile, imports from other countries increased to fulfill the demand previously met by U.S. exports.

  • Most Canadian provinces and territories, except two, have stopped purchasing, distributing, or retailing U.S. alcoholic beverages, unlike their policies towards other countries.

    • From March 2025 to February 2026, Canadian imports of U.S. alcoholic drinks dropped by 81%, equivalent to a $582 million decrease from the prior year.

  • Canada’s dairy system includes complex protectionist measures, imposing stricter tariff-rate quotas on U.S. cheese compared to imports from the EU, despite having trade agreements with both.
  • In the last year and a half, only China and Canada have retaliated against President Trump’s tariffs rather than negotiating a settlement with the United States.
  • The newly imposed Section 338 tariffs are designed to bolster the U.S. economy by counterbalancing the negative effects of Canada’s treatment of U.S. commerce.
