MEMORANDUM FOR THE ADMINISTRATOR OF THE ENVIRONMENTAL PROTECTION AGENCY
THE SECRETARY OF THE AIR FORCE
SUBJECT: Presidential Determination on the Air Force’s Jet Fighter Training Activities in Idaho, Oregon, and Nevada
By the authority granted to me as President under the Constitution and U.S. laws, specifically section 313 of the Federal Water Pollution Control Act, as amended (33 U.S.C. 1323), I find it essential for the United States to exempt the Air Force’s jet fighter training operations in Idaho, Oregon, and Nevada from Federal, State, interstate, and local regulations, administrative authority, and sanctions related to water pollution control and abatement. These operations are currently involved in litigation in Oregon Natural Desert Ass’n v. Meink, Case No. 2:23-cv-01898 (D. Or.).
Therefore, according to subsection (a) of section 313 of the Federal Water Pollution Control Act, as amended (33 U.S.C. 1323(a)), I hereby exempt these Air Force training activities from Federal, State, interstate, and local regulations concerning water pollution control and abatement, with the exception of the requirements set forth in 33 U.S.C. 1316 and 1317.
This exemption is effective for a one-year period starting April 20, 2026, and ending April 20, 2027.
This memorandum does not imply that, without this Presidential exemption, the Clean Water Act or any other legal provision would mandate the Air Force to secure permits related to water pollution control for these operations. It also does not limit the applicability or enforcement of any other legal requirements relevant to the Air Force’s jet fighter training in Idaho, Oregon, and Nevada.
The Secretary of the Air Force is instructed to publish this determination in the Federal Register.
