South African opposition parties are up in arms over the government’s alleged “backdoor deal” with Elon Musk. The government proposed to relax Black empowerment laws to accommodate Musk’s Starlink telecoms group entering the country, sparking outrage among political figures.

Build One South Africa (Bosa) party accused the government of favoring foreign billionaires over local businesses by bending the rules for Musk. They demanded transparency and accountability in the decision-making process to ensure it was not a shady deal.

Julius Malema, leader of the Economic Freedom Fighters, vowed to oppose Starlink’s entry into the market, emphasizing the need to prioritize national interests over business demands.

The controversy stems from a recent proposal by communications minister Solly Malatsi to exempt telecoms companies from the requirement to sell 30% equity to historically disadvantaged groups in exchange for operating licenses. This move was seen as a way to accommodate Musk’s refusal to comply with Black Economic Empowerment regulations.

Critics argue that the government’s actions undermine the principles of Black empowerment and affirmative action, which aim to address the legacy of apartheid and promote economic inclusion for marginalized communities.

The debate over Black ownership requirements extends beyond telecoms to the mining sector, with calls for similar exemptions gaining momentum. The Minerals Council South Africa has advocated for exploration companies to be excluded from Black ownership rules to stimulate investment in the industry.

The Democratic Alliance has taken legal action against the ANC’s BEE ownership laws, claiming they are unconstitutional and detrimental to foreign investment in the mining sector. President Cyril Ramaphosa has defended BEE laws as essential for economic transformation but faces growing opposition to their implementation.
