The case on trans health care currently before the Supreme Court highlights the importance of personalized health care for all patients. The legal battle over state bans on health care for transgender youth has been ongoing since 2021, with conflicting rulings from different courts. Some judges have deemed these bans discriminatory, while others argue that they protect minors and that transgender youth should wait until legal adulthood to access gender-affirming care.

The specific question before the Supreme Court in the case of U.S. v. Skrmetti is whether Tennessee’s ban on gender-affirming care violates the Constitution by denying access to hormones and puberty-pausing medications based on sex. During the December arguments, flawed justifications for the ban were brought up, but the justices must focus on the constitutional implications rather than scientific evidence.

Chief Justice John Roberts raised concerns about the court’s role in making medical decisions, suggesting that such matters should be left to the people’s representatives. This brings up the issue of rational basis and whether laws encroach on constitutional rights or serve legitimate government interests.

As medical professionals, we believe that the power to make medical decisions should ultimately lie with patients and their families. Trans health care exemplifies the importance of individualized care, with guidelines that prioritize the partnership between providers and patients. This approach recognizes the expertise of both parties and aims to create a tailored care plan that respects the patient’s lived experiences.

The impact of trans health care goes beyond medical interventions; it encompasses psychological well-being and resilience in the face of societal stigma and discrimination. Facilitating gender euphoria, or authentic self-expression, can lead to positive health outcomes and a sense of hope for the future.

Unfortunately, bans on gender-affirming care not only harm transgender individuals but also affect others in need of specialized interventions that support identity formation and community-building. Providers face ethical dilemmas and fears of privacy breaches due to state-level restrictions on certain medical practices.

Lawmakers who push for these bans lack the expertise to make informed medical decisions and often disregard the potential benefits of trans health care principles for all patients. We urge the Supreme Court to recognize the importance of patient autonomy in medical decision-making and to reject laws that undermine constitutional rights to equal protection.
