Sergeant Erik Duran, a member of the NYPD, is currently on trial in Bronx Criminal Court for the death of Eric Duprey, a 30-year-old man who tragically lost his life nearly three years ago. The incident occurred on August 23, 2023, during a drug bust operation in Kingsbridge Heights.

During the trial’s opening statements, Duran’s defense attorney, Andrew Quinn, argued that the officer acted out of fear for his life when he made a split-second decision to throw a cooler at Duprey, who was riding a scooter at 30 mph towards Duran and others. Quinn emphasized that Duran’s actions were in line with the training of law enforcement officers to step towards danger in such situations to protect lives.

The prosecution, led by the state attorney general’s office, accused Duran of using unnecessary force that resulted in Duprey’s death. They claimed that Duprey was not a threat to anyone’s life and that Duran’s actions were reckless and violent. The court was shown surveillance footage of the moment when Duran threw the cooler, striking Duprey in the head, causing him to crash into a tree and suffer fatal blunt force trauma.

Angel Chiohh, the Attorney General’s Investigative Counsel, described the severity of Duprey’s injuries, highlighting the gruesome details of the scene where pieces of his brain were found scattered. Chiohh argued that there was no imminent danger that warranted such a response from Duran and that his actions were driven by frustration during the failed operation.

Duran, who pleaded not guilty to the charges of second-degree manslaughter, assault, and criminal negligent homicide, faced a potential sentence of up to 25 years in prison if convicted. The trial drew emotional reactions from both Duran’s and Duprey’s families, as well as supporters on both sides.

The outcome of the trial will depend on the judge’s decision, considering the arguments presented by both the defense and the prosecution. The case has raised questions about the use of force by law enforcement officers in high-pressure situations and the consequences of such actions. The trial will continue to unfold as more evidence is presented, shedding light on the events that led to Duprey’s tragic death.
