The Department of Justice under Trump has responded vigorously after a judge appointed by Biden seemingly disregarded the US Supreme Court’s authority. This judge has maintained that his order preventing the deportation of undocumented migrants to South Sudan remains valid.
On Monday evening, US District Judge Brian Murphy defied the Supreme Court’s recent 6-3 ruling that permitted the Trump Administration to resume deportations of illegal aliens to âthird-partyâ countries.
The Supreme Court had granted the Trump Administrationâs emergency application, effectively pausing Judge Murphyâs injunction against these deportations.
Yet, on the same evening, Judge Murphy reaffirmed that his previous order remains in force, stating, âThe Courtâs May 21, 2025 Order on Remedy remains in full force and effect, notwithstanding todayâs stay of the Preliminary Injunction.â
By Tuesday morning, Solicitor General John Sauer had formally requested the Supreme Court to clarify its decision.
