The Illinois Department of Labor has taken legal action against a now-closed West Loop restaurant, That’s Gino and Marty’s, and its management for allegedly withholding wages from employees. The lawsuit, filed against That’s Gino and Marty’s, LLC, White Glove Service and Management, LLC, and various individual owners and managers, accuses the restaurant of violating state minimum wage and overtime laws.

Gino & Marty’s, located at 844 West Randolph Street, was once known as a trendy Chicago Italian restaurant with a modern twist. However, the restaurant faced financial troubles last year, with reports of eviction threats, tax liens, and multiple wage theft complaints.

The civil complaint alleges that employees at the restaurant were not paid their full wages from December 2023 to August 2025. The state claims that workers were denied proper tip and gratuity payments, paid below the Illinois minimum wage, and not compensated for overtime hours worked.

Following a preliminary investigation, the Department of Labor found that at least nine employees are owed over $20,000 in unpaid wages. The state is seeking additional damages and statutory penalties as allowed by Illinois law.

Director of the Illinois Department of Labor, Jane Flanagan, emphasized the importance of fair and timely payment for workers. She stated, “Illinois law is clear: workers must be paid fully, fairly, and on time. When employers withhold earned wages or fail to comply with minimum wage and overtime laws, the Department will take action to recover owed wages and hold accountable those responsible.”

The lawsuit was filed by the Office of the Illinois Attorney General on behalf of the Department of Labor. This legal action serves as a reminder of the consequences for businesses that do not adhere to labor laws and mistreat their employees.
