In a twist that could rival a political thriller, Texas Governor Greg Abbott has summoned lawmakers for a special session to redraw congressional district boundaries. This call to arms follows a stern letter from the Department of Justice (DOJ), which has raised alarms about the constitutionality of certain districts.

On July 24, the Texas House of Representatives found itself grappling with a request from the DOJ to reassess congressional district lines amidst allegations that some districts have been drawn with racial demographics in mind—an accusation that could run afoul of the Voting Rights Act.

In a letter to Abbott, the DOJ articulated concerns over four specific districts in the Houston and Dallas areas (the Ninth, 18th, 29th, and 33rd), labeling them as racially gerrymandered during the post-2020 census redistricting. All four districts are currently under Democratic representation, raising suspicions of strategic manipulation.

Abbott, sensing an opportunity to reshape the political landscape, has urged Congress to consider a mid-decade overhaul in light of these developments, alongside other legislative matters.

The push to revamp the congressional map before the 2030 census has not gone unnoticed by Texas Democrats, who are preparing for battle with threats of filibusters, walkouts, and other forms of resistance to the proposed bill.

Former President Donald Trump weighed in on the situation, expressing optimism that a simple redrawing could allow Republicans to gain as many as five seats—an enticing prospect for a party looking to avoid the pitfalls that typically accompany midterm elections.

Yet, this strategy is fraught with peril; a miscalculation could just as likely result in Republicans losing ground.

DOJ Claims

A July 7 letter from the DOJ to Abbott asserted that the aforementioned districts were unconstitutionally drawn with racial considerations, classifying them as “coalition districts.” These districts, which represent a collective of racial minorities, could face legal challenges under the Voting Rights Act.

The DOJ referenced a precedent set in the 2023 Supreme Court case Allen v. Milligan, where Justice Brett Kavanaugh noted the limitations of race-based redistricting, indicating that the authority to engage in such practices cannot be indefinite.

Abbott responded to the DOJ’s concerns by calling for a special session starting July 21, lasting 30 days, to address these “constitutional concerns.” Republican lawmakers have promised that any new maps will adhere to legal standards, with state Sen. Phil King expressing confidence that no bill violating the Voting Rights Act will emerge from the committee.

Timing Draws Questions

While congressional redistricting typically occurs every decade in alignment with the U.S. Census, mid-decade adjustments are not unheard of, often prompted by shifts in political power. The DOJ’s letter has reignited discussions about potentially illegal districts that need restructuring after the 2021 redistricting process.

Michael Li, a redistricting expert at NYU’s Brennan Center for Justice, labeled this move as “totally unprecedented,” highlighting the unusual nature of a party seeking to redraw maps after having already gained favorable outcomes.

In the 2021 redistricting, the Texas GOP aimed to consolidate their control over the state’s 38 House seats, currently held by 25 Republicans and 12 Democrats, with one seat vacant due to the passing of Rep. Sylvester Turner.

However, the GOP risks backlash; a poorly executed map change could backfire, potentially diluting Republican-majority districts by introducing more Democratic voters.

Democrat Pushback

Despite their minority status in the Texas Legislature, Democrats are ramping up their resistance to the proposed changes. State Rep. Gene Wu emphasized that they will pursue all avenues to safeguard their communities, including physical blockades to prevent map redrawing.

Democrats have threatened walkouts to deny Republicans a quorum, as well as filibusters that could delay proceedings but might not prevent passage altogether. Texas Attorney General Ken Paxton has warned of potential arrests for lawmakers who attempt to walk out, alongside hefty fines for quorum violations.

Democrats are framing the redistricting effort as a blatant power grab, a sentiment echoed by U.S. Rep. Joaquin Castro during the July 24 hearing, where he asserted that lawmakers were being manipulated and cautioned against creating a ripple effect prompting similar actions in other states.

Other Agenda Items

Beyond redistricting, Abbott’s special session agenda encompasses a range of contentious issues, including natural disaster preparedness, property taxes, and education policies. Abbott articulated a commitment to addressing the aftermath of recent devastating floods, asserting that more proactive measures are necessary for Texas citizens.

While Abbott’s spokesperson did not address redistricting directly, he underscored the governor’s focus on delivering substantive results on pressing issues rather than engaging in political squabbles.

With a limited window for decision-making, the House faces a ticking clock regarding the proposed maps.

Other States’ Plans

Texas is not alone in this redistricting frenzy. Ohio Republicans are also contemplating changes to their House maps, while the White House is monitoring potential adjustments in other states, which may not necessarily favor Republican interests.

California’s Governor Gavin Newsom has hinted at similar maneuvers, potentially bypassing the state’s redistricting commission to create a more Democrat-friendly map. Meanwhile, U.S. House Democratic Leader Hakeem Jeffries is in discussions with New York Governor Kathy Hochul about potential adjustments in their state.

In a recent podcast, Jeffries emphasized the need for all states to consider their redistricting strategies, urging a collective response to Republican maneuvers. Hochul echoed this sentiment, vowing to explore all options available to ensure fairness in the electoral landscape.
