Another defense motion hits the courtroom floor.

As the spotlight dims on Sean “Diddy” Combs’ high-profile criminal trial, Judge Arun Subramanian made it clear that he isn’t entertaining the defense’s latest gambit.

Diddy’s legal team sought to dismiss his conviction on prostitution-related charges or, failing that, to obtain a new trial altogether.

The motion aired during a tense hearing last Thursday.

According to CNN, Judge Subramanian’s ruling, issued on Tuesday, dismissed Diddy’s legal arguments. He reiterated that the defense’s interpretation of prostitution—as well as the relevance of the First Amendment in the context of amateur pornography—was, to put it mildly, a stretch.

As Judge Subramanian laid bare, “The definition of prostitution in regard to the Mann Act should not be constrained, nor should Mr. Combs’ claims of First Amendment protection concerning his activities as a producer and consumer be entertained.”

Judge Subramanian’s decision arrived in the wake of a government filing suggesting that Combs be sentenced to over 11 years behind bars.

Prosecutors argue that the complaints against Combs reveal a disturbing pattern of both physical and emotional abuse directed at his former partners and employees.

“In a comprehensive 161-page filing, prosecutors implored Judge Subramanian to deny Combs’ plea for a mere 14-month sentence—essentially a slap on the wrist,” the report stated. “They asserted that he has not exhibited a shred of remorse, instead placing blame squarely on the victims themselves.”

Prosecutors noted, “Time and again, Mr. Combs has demonstrated a singular concern for his own power and domination. A mere fleeting detainment will not suffice; he requires a significant term that underscores the accountability of abusers—regardless of their societal standing—while assuring future victims that justice will prevail.”

The prosecution also indicated a desire for the maximum financial penalty of $500,000.

“The US probation department elaborated, recommending a punitive period of incarceration ranging from five to seven years. The court has scheduled Diddy’s sentencing for this upcoming Friday,” they stated.
