The upcoming 2024 election has Democrats on Capitol Hill worried about the potential for chaos on Jan. 6, 2025. While they are hopeful that Kamala Harris will emerge victorious and that they will flip the House, there are concerns about Speaker Mike Johnson retaining his majority and obstructing the electoral vote count.

Johnson, who previously led House Republicans in challenging swing-state election results, is now raising doubts about undocumented immigrants voting in an effort to sow election mistrust. Democrats fear that he may try to throw the election to the House under the constitutional provisions of the 12th Amendment.

Despite the safeguards in place, such as the 2022 Electoral Count Act rewrite, Democrats remain anxious about unresolved ambiguities in the Constitution and the law surrounding the certification process. Johnson’s legal background, conservative credentials, and potential allegiance to Trump raise concerns about his ability to manipulate the electoral process.

While these scenarios may seem far-fetched, the unexpected events of the 2020 election have taught Democrats to be prepared for any eventuality.

Senior lawmakers are already strategizing for various post-election outcomes and mobilizing donors to ensure the party’s success in flipping the House. While there is faith that Johnson will do the right thing in a contested scenario, Democrats are leaving nothing to chance and are prepared to navigate any potential challenges that may arise.
