A grand jury decision on Wednesday declined to indict a federal immigration agent for the fatal shooting of a US citizen, Ruben Ray Martinez, during a traffic encounter in Texas last year. The shooting by a Homeland Security Investigations agent was initially undisclosed until media reports surfaced.

The Cameron County District Attorney’s Office revealed that the grand jury opted not to bring charges after reviewing the case. The Department of Homeland Security alleged that Martinez intentionally ran over an HSI special agent, leading to defensive shots being fired.

Martinez’s family attorneys are questioning the accuracy of DHS’ account and are requesting the Texas Department of Public Safety to disclose investigation findings for transparency.

The incident report from ICE described officers’ actions during the encounter, while a draft affidavit from a passenger in Martinez’s car contradicted the officers’ version of events. The passenger, Joshua Orta, who was a key witness, passed away in a car crash recently.

Martinez’s family emphasized their support for law enforcement but called for honesty and decency in handling the case. The shooting occurred during a Spring Break trip to South Padre Island, and the details of the incident remain under scrutiny.
