California Appeals Court Upholds Weinstein Rape Conviction

LOS ANGELES (AP) — On Friday, an appeals court confirmed Harvey Weinstein’s 2022 conviction for rape and sexual assault in California, while mandating a resentencing from the trial judge.

The decision was reached unanimously by a three-judge panel from California’s 2nd District Court of Appeal.

In an email, Weinstein spokesperson Juda Engelmayer expressed their dissatisfaction with the decision and disagreed with the Court of Appeal’s conclusions about the trial’s fairness. Engelmayer acknowledged, however, that the court correctly found Weinstein’s sentence should be reconsidered.

This ruling followed a decision by New York prosecutors, announced a day earlier, that Weinstein would not face a fourth trial there. The case was dropped on Thursday after the accuser expressed an inability to testify again.

In California, Weinstein, aged 74, was convicted in December 2022 for one count of rape and two counts of sexual assault involving an Italian model and actor identified during the trial as Jane Doe 1. He received a 16-year prison sentence.

Weinstein’s lawyers, in their appeal, contended that Superior Court Judge Lisa B. Lench unfairly limited testimony from the head of a film festival during his Los Angeles County trial, and they were seeking a new trial.
