In accordance with the powers granted to me as President under the Constitution and the laws of the United States, I hereby issue the following directive:

Section 1.  Objective.

This directive serves to amend Executive Order 13603, originally issued on March 16, 2012, which pertains to National Defense Resources Preparedness. Executive Order 13603 allocates specific presidential authorities under the Defense Production Act (50 U.S.C. 4501 et seq.) to designated heads of executive departments and agencies. This order also seeks to clarify section 2(a) of Executive Order 14156, enacted on January 20, 2025, which declares a National Energy Emergency.

Sec. 2.  Modification of Executive Order 13603.

Section 203 of Executive Order 13603 is revised by removing the term “Secretary of Commerce” and replacing it with “Secretary of Commerce and the Secretary of Energy, each of whom is empowered to exercise the delegated authority independently.”

Sec. 3.  Clarification of Section 2(a) of Executive Order 14156.

To eliminate any potential confusion, it is clarified that an agency head is required to recommend actions to the President under section 2(a) of Executive Order 14156 only when that authority is uniquely vested in the President and has not been delegated. There is no obligation for an agency head to seek presidential approval when they possess the authority to act independently due to a delegation from Executive Order 13603 or other presidential directives.

Sec. 4.  General Provisions.

(a)  This directive must not be interpreted as impairing or altering:

  • (i)   the legal authority granted to any executive department or agency, or its head;
  • (ii)  the responsibilities of the Director of the Office of Management and Budget concerning budgetary, administrative, or legislative matters.

(b)  This order will be enforced in accordance with applicable laws and subject to the availability of funds.

(c)  This order is not designed to, nor does it, establish any rights or benefits, either substantive or procedural, that can be enforced legally or equitably by any individual against the United States, its departments, agencies, or their officials, employees, or agents, or any other person.

(d)  The costs associated with the publication of this order will be covered by the Department of Energy.
