Man cleared of filming sex without consent

Man acquitted of filming sex on Snapchat, found guilty of showing video

A man has been acquitted of filming himself having sex with a woman he met on Tinder after his lawyer argued she was too drunk to give consent. However, he was found guilty of showing the video to a mutual friend.

During the trial in the Hamilton District Court, the judge took into consideration the woman’s admission of being heavily intoxicated, which raised questions about the reliability of her recollection of events.

The defendant’s lawyer requested a discharge without conviction and was granted interim name suppression to protect the young man’s reputation.

The encounter between the man and woman started on Tinder and progressed to a night of drinking before they went to his house. The woman admitted to being near blackout drunk and had flashbacks of being filmed without her consent.

The woman’s friend later discovered the videos on the man’s phone and was shown one of them on Snapchat, leading to a confrontation where the man denied calling her derogatory names.

Despite the acquittal on the filming charge, the judge expressed suspicion that the videos were shared more widely than claimed by the defendant. The man’s explanation for keeping the videos as evidence was deemed self-serving and questionable.
