William Swetz, the man accused of throwing a Big Gulp of root beer in the face of former Cook County State’s Attorney Kim Foxx during a roadside altercation, recently stood trial in Markham. The two-day bench trial took place before Judge Tiana Blakely, with the Illinois Attorney General’s Office prosecuting Swetz on charges of aggravated assault with a motor vehicle and aggravated battery in a public place.

During the trial, Assistant Attorney General Suzanne Collins offered Swetz a plea deal, allowing him to plead guilty to one of the felonies in exchange for probation and anger management classes. However, Swetz declined the offer, leading to the trial proceeding.

The incident occurred in June 2024 near Foxx’s home in Flossmoor. Foxx, who was out for a morning walk, was confronted by Swetz as she walked along the edge of the roadway. Swetz allegedly yelled obscenities at Foxx, prompting her to respond with a gesture before Swetz reversed his truck towards her, forcing her to jump onto the curb to avoid being hit. The confrontation escalated when Swetz threw the contents of his Big Gulp cup at Foxx.

During the trial, Foxx provided a detailed account of the incident, stating that she felt fearful for her physical safety during the encounter. Other witnesses, including a Flossmoor resident and a detective, corroborated Foxx’s version of events.

The defense argued that the incident was a noncriminal encounter between Swetz and Foxx, questioning whether Foxx’s reaction was genuine. However, the prosecution maintained that Swetz’s actions were deliberate and intended to cause harm to Foxx.

Closing arguments saw the prosecution accusing the defense of victim-blaming and emphasizing the impact of the incident on Foxx. The defense, on the other hand, argued that the charges against Swetz were excessive and that the altercation was a moment of mutual anger between two adults.

Judge Blakely is set to deliver her verdict on November 17, determining Swetz’s fate in the case. The trial shed light on a contentious confrontation that took place in a residential neighborhood, involving a public figure and a private citizen.

As the trial proceedings come to a close, the outcome will have implications for both Swetz and Foxx, highlighting the importance of addressing conflicts in a peaceful and lawful manner. The verdict will serve as a decision on accountability and justice in a case that captured public attention.
