In a controversial move, Illinois has opened the doors for undocumented immigrants to access state and local student financial aid. Governor J.B. Pritzker has put pen to paper, signing a law that will come into effect on January 1, 2026, allowing illegal aliens to benefit from grants, scholarships, and stipends intended for higher education.

This development unfolds amidst ongoing litigation from the Trump Justice Department, which is actively suing several states over similar initiatives. The crux of the argument? Funds allocated for American citizens should not be diverted to individuals residing in the country illegally.

This issue strikes at the heart of a recurring theme in Trump’s political narrative.

New Illinois Law Set to Allow Financial Aid for Undocumented Students

Gov. J.B. Pritzker (D-IL) has signed House Bill 460, a law granting eligibility for state and local financial aid to illegal alien students, which critics argue will detract from grants and scholarships available to citizens and legal residents. The law is scheduled to take effect on January 1, 2026.

“If you live in Illinois and are pursuing higher education, you should have access to the same opportunities as your peers,” stated Illinois state Sen. Celina Villaneuva (D-Chicago).

Proponents of the law argue it will provide crucial support to undocumented students who currently do not qualify for federal assistance, thereby enhancing their prospects for attending college and contributing to the state’s workforce.

According to estimates, Illinois is home to more than 500,000 undocumented immigrants, with approximately 27,000 currently enrolled in public colleges or universities. However, the U.S. Department of Justice has filed a lawsuit against Illinois, asserting that offering in-state tuition to noncitizen migrants breaching federal law. The DOJ contends this practice provides benefits to “illegal aliens” that are not extended to U.S. citizens from other states.

As noted by Harmeet Dhillon, this new law is bound to spark outrage among Illinois taxpayers, who are already feeling the weight of their financial burdens.
