STRENGTHENING AMERICA’S CRITICAL MINERALS FUTURE: In a significant move today, President Donald J. Trump signed an Executive Order to investigate the national security implications of the United States’ reliance on imported processed critical minerals and their derivatives.

  • The Order mandates the Secretary of Commerce to commence a Section 232 investigation under the Trade Expansion Act of 1962, focusing on how imports of these vital materials affect America’s security and resilience.
  • This investigation will scrutinize potential weaknesses in supply chains, assess the economic repercussions of foreign market manipulation, and explore trade remedies to ensure a secure and sustainable domestic supply of these crucial materials.
  • The findings will culminate in a detailed report outlining risks and offering recommendations aimed at bolstering domestic production, reducing reliance on foreign sources, and enhancing both economic and national security.
  • If the Secretary of Commerce determines that imports of critical-mineral products pose a national security threat and the President opts to impose tariffs, any resulting tariff rate will supersede the existing reciprocal tariff rate as per President Trump’s order from April 2.

ADDRESSING THREATS TO NATIONAL SECURITY AND ECONOMIC STABILITY: President Trump has acknowledged that an excessive dependence on foreign critical minerals and their derivatives could undermine U.S. defense capabilities, infrastructure growth, and technological advancement.

  • Critical minerals, including rare earth elements, are indispensable for national security and economic stability.

    • Processed critical minerals and their derivatives serve as fundamental components of our defense industrial base, vital for technologies such as jet engines, missile guidance systems, advanced computing, radar, advanced optics, and secure communication systems.

  • The United States currently finds itself heavily reliant on foreign sources—particularly from adversarial nations—for these essential materials, which exposes both the economy and defense sector to potential supply chain disruptions and economic coercion.
  • Foreign producers have resorted to price manipulation, overproduction, and arbitrary export restrictions, leveraging their dominance in the supply chain for geopolitical and economic advantages over the United States.
  • Just a few months back, China enacted a ban on exports to the U.S. of gallium, germanium, antimony, and other critical high-tech materials that have potential military applications.
  • This week, China escalated tensions by halting exports of six heavy rare earth metals and rare earth magnets, aiming to restrict supplies critical to automakers, aerospace manufacturers, semiconductor firms, and military contractors globally.

EMPOWERING AMERICAN INDUSTRY: This Executive Order is a continuation of the Trump Administration’s efforts to align U.S. trade policy with the nation’s long-term interests.

  • From Day One, President Trump has championed an America First Trade Policy designed to rejuvenate the U.S. economy.
  • On Liberation Day, President Trump implemented a 10% tariff across all nations and tailored reciprocal higher tariffs on countries with which the U.S. has significant trade deficits, thus striving to level the playing field and safeguard America’s national security.
    • Over 75 countries have reached out to negotiate new trade agreements as a result.

    • Consequently, the individualized higher tariffs are currently on hold amid these discussions, with the exception of China, which retaliated against U.S. tariffs.

    • As a result, China now faces tariffs as high as 245% on its exports to the United States due to its retaliatory measures.

  • President Trump has also taken steps to eliminate existing loopholes and exemptions, reinstating a true 25% tariff on steel and raising it to 25% on aluminum.
  • He introduced the “Fair and Reciprocal Plan” aimed at restoring equity in U.S. trade relations and countering non-reciprocal trade agreements.
  • In addition, President Trump signed a memorandum to protect American innovation, including considering tariffs to confront digital service taxes (DSTs) and foreign government practices that penalize American businesses.
  • Moreover, similar Executive Orders have been signed to investigate how imports of copper and timber, lumber, and their derivatives threaten America’s national security and economic stability.
