MAXIMIZING PERFORMANCE IN FEDERAL CONTRACTS: Today, President Donald J. Trump enacted an Executive Order mandating that agencies prioritize fixed-price and performance-based contracts to ensure prompt and complete delivery of services.

  • The Order stipulates that agencies should prioritize fixed-price contracts and those linking contractor profits to performance metrics during procurement.
  • It requires agencies to notify and, in certain cases, obtain approval from agency heads for employing alternative contract types, with specific exceptions for emergencies and major systems research and development.
