Alec Baldwin will not be facing charges in connection to the shooting incident on the set of the film “Rust” that resulted in the death of cinematographer Halyna Hutchins in October 2021. Special prosecutor Kari T. Morrissey announced on December 23 that the appeal to reinstate charges against Baldwin has been dropped due to lack of support from the New Mexico district attorney’s office.

The prosecution’s case against Baldwin fell apart during the trial in July when his lawyers successfully argued that the prosecution had withheld evidence related to the case. Morrissey stated in a news release that the state’s efforts to prosecute the case fully have been hindered by various barriers.

The decision to dismiss the appeal was praised by the New Mexico First Judicial District Attorney’s Office, which also expressed support for Hutchins’ family in their pursuit of justice through civil court. Baldwin’s attorneys, Luke Nikas and Alex Spiro, declared that the dismissal of the appeal vindicates their client, emphasizing that Baldwin had committed no crime in the tragic incident.

Despite denying pulling the trigger, Baldwin was charged with involuntary manslaughter in January 2023 and pleaded not guilty. The charges were dropped in April 2023, only to be re-indicted earlier this year. The case went to trial in July but was ultimately dismissed by First Judicial District Judge Mary Marlowe Sommer, who agreed with Baldwin’s legal team that crucial evidence had been withheld by prosecutors.

The film’s armorer, Hannah Gutierrez-Reed, was found guilty of involuntary manslaughter in March and sentenced to 18 months in prison. Her appeal for a new trial was denied in September.

Hutchins’ family filed a wrongful death lawsuit against Baldwin in February 2022, which was settled in October of the same year. Baldwin has refrained from commenting publicly on the recent decision, but he shared a link to a New York Times article about it on social media. The actor has maintained his innocence throughout the legal proceedings and continues to mourn the tragic loss of Halyna Hutchins.
