In December, a tragic incident occurred in Fairfax County, Virginia, when Marvin Morales‑Ortez, an illegal immigrant, was released from jail despite facing serious charges, including a violent assault and a firearm offense. Within 24 hours of his release, Morales‑Ortez allegedly committed a murder. This heartbreaking event shed light on the controversial policies of Fairfax’s Commonwealth’s Attorney Steve Descano, who openly prioritizes avoiding “immigration consequences” when charging criminals, leading to leniency towards illegal immigrants over US citizens.

Descano’s policy, along with similar ones adopted by other progressive prosecutors across the country, raises concerns about preferential treatment for criminal aliens at the expense of American citizens. By dropping or reducing charges, these prosecutors effectively shield illegal immigrants from deportation, even after committing serious crimes. This unequal treatment not only poses a danger to public safety but also violates civil-rights laws that prohibit discrimination based on national origin.

The issue of prosecutors granting special consideration to illegal immigrants over citizens is not unique to Fairfax. Across the nation, district attorneys have implemented policies that prioritize the well-being of noncitizens over US citizens, citing reasons such as “equity,” “collateral consequences,” or “compassion.” These policies lead to disparities in the justice system and undermine the principle of equal justice under the law.

It is crucial for the Department of Justice to intervene and investigate prosecutors who engage in discriminatory practices towards illegal immigrants. Just as DOJ has conducted civil-rights investigations into police departments, it should hold prosecutors accountable for violating the rights of American citizens by favoring criminal aliens. Equal justice under the law is a fundamental principle that must be upheld to ensure public safety and fairness in the criminal justice system.

The tragic outcome of Morales‑Ortez’s release serves as a stark reminder of the consequences of prioritizing immigration status over justice. The Justice Department must take action to address these injustices and uphold the rights of all individuals, regardless of their citizenship status. Only by enforcing equal justice under the law can we prevent further tragedies and maintain the integrity of the legal system.
