A 21-year-old man, already on electronic monitoring for a gun-related incident, has been sentenced to four years in prison after his accomplice was killed in a botched robbery attempt at a gas station on the South Side.

Tommy Moore received a three-year sentence for aggravated battery in a public space, along with an additional year for a separate felony involving a firearm, as decided by Judge Stanley Sacks. At the time of the incident, he was wearing an electronic ankle monitor due to the previous case.

The incident took place around 11:15 a.m. on August 28, 2024, as captured by surveillance cameras in Falcon Fuel located at 7600 South Halsted Street. The footage indicates that the 37-year-old victim was using an ATM when Moore and his partner, 37-year-old Toron Davis, approached him. Shortly after, Davis was seen taking items from the victim’s pockets, according to the police report.

After Davis allegedly grabbed the victim by his dreadlocks and attempted to force him outside, the victim retaliated by pulling out a knife and slicing Davis’ neck. The three men then ended up struggling on the floor, where Moore allegedly hit the victim with a handgun before making his escape.

According to police, Davis managed to stagger out of the minimart, clutching his neck, but collapsed against a pickup truck parked at the gas station. He was later pronounced dead at the University of Chicago Medical Center.

Investigators reported that Moore fled the scene and concealed his weapon under the passenger seat of a vehicle nearby before police arrived.

Court documents revealed that Moore had been under electronic monitoring for the past five months due to a stolen firearm case related to an event on the 5500 block of South Wells Street. Conversely, Davis had been free on pretrial release for a DUI charge and had missed court appearances for seven consecutive months prior to his death.
