Several proposed class-action lawsuits have been filed against billionaire Elon Musk, alleging that his political action committee, America PAC, engaged in fraud by falsely promising voters a chance to randomly win $1 million when winners had actually been predetermined.

In October, Musk established America PAC to support President-elect Donald Trump’s presidential campaign. To entice Trump supporters in battleground states, Musk offered them a chance at the cash prize if they provided personal information and signed a petition in support of “free speech and the right to bear arms.”

Between October 19 and November 5, Musk distributed at least $16 million to over a dozen winners.

At a rally for Trump, Musk announced the $1 million giveaway to petition signers, which prompted Philadelphia District Attorney Larry Krasner to challenge Musk for running an illegal lottery scheme.

Despite the legal challenge, Musk’s PAC continued the payouts, arguing that the winners were selected based on their suitability to represent the PAC, not through random selection.

Subsequently, Musk faced three lawsuits accusing him of fraud and breach of contract for deceiving voters about their chances of winning.

One of the lawsuits was filed by Jacqueline McAferty of Arizona, who claimed she was misled into providing personal information to America PAC under the false pretense of being eligible for the $1 million prize.

Attorney Josh Sanford emphasized that the lawsuits are not politically motivated but rather aim to hold Musk accountable for his dishonesty.

Another lawsuit was filed by a Michigan lawyer, followed by a separate lawsuit from Texas lawyer Mark Bankston on behalf of Joy Harvick of Arizona.

The complaints allege that Musk and his PAC promoted the petition as a random chance to win $1 million while actually selecting winners based on predetermined criteria.

Bankston, known for representing Sandy Hook families against Alex Jones, condemned Musk’s actions, stating that such deceit during an election is unacceptable.

Musk’s America PAC is also facing a class-action lawsuit from canvassers who claim they were not paid as agreed.

Despite requests for comment, Musk’s attorney Alex Spiro remained silent on the matter.

Bankston intends to add more plaintiffs to the lawsuit and encourages anyone who believed they had a random chance to win the prize to come forward.
