In an unexpected twist in California’s ongoing political saga, Governor Gavin Newsom has filed for an ex parte Temporary Restraining Order (TRO) against President Trump. The contention arises over the deployment of National Guard troops to downtown Los Angeles, a move that Newsom argues could escalate tensions rather than provide relief.

The legal complaint has been assigned to Judge Charles Breyer, a Clinton appointee and brother of retired Supreme Court Justice Stephen Breyer, indicating that the case will be scrutinized under a judicial lens that may reflect on both state and federal powers.

“Immediate action is necessary,” the lawsuit asserts, underscoring the urgency of the situation.

Newsom has urged the Court to grant the TRO by 1 PM today, emphasizing the need for swift intervention.

“The plaintiffs respectfully request that the Court issue a temporary restraining order and preliminary injunction to prevent the Department of Defense (DOD) from taking actions outlined in the plaintiffs’ concurrently filed Proposed Order and Order to Show Cause,” the court documents state.

According to Newsom, the motion is grounded in the Ex Parte Motion, the Complaint for Declaratory and Injunctive Relief (Doc. 1), along with a comprehensive Memorandum of Points and Authorities, a proposed Temporary Restraining Order, and supporting declarations. All evidence and records relevant to the case will also be considered, ensuring a robust legal groundwork.

“As articulated in the accompanying Memorandum of Points and Authorities, a TRO is essential by 1:00 PM on June 10, 2025, to avert immediate and irreparable harm to the plaintiffs. Without immediate injunctive relief, the military’s involvement and the federalized National Guard’s role in community patrolling and law enforcement could threaten State Sovereignty, drain vital resources, heighten tensions, and ultimately incite civil unrest rather than quell it. Thus, the plaintiffs seek a TRO and preliminary injunction to maintain the current landscape,” Newsom elaborated in the legal filing.
