A PROCLAMATION
Fertilizers are crucial for agriculture and food production. Corn, soybeans, wheat, and various other crops rely on phosphate fertilizers to produce strong yields necessary for feeding the population. Reliable food production is vital for human health, farm security, and the economy’s functioning. Even minor disruptions can have serious health and economic effects, underlining the importance of stable food production for the United States’ economic and national security.
During planting and growing seasons, soil and crops need essential nutrients like phosphorus from phosphate fertilizers. Farmers will use over half of the annual phosphate fertilizers between fall and early spring before the next planting season. To maintain a stable food supply, it is crucial to secure timely and predictable sources of phosphate fertilizer to meet U.S. demand, ensuring an adequate supply of this vital plant nutrient.
Recently, global supply chains for phosphate fertilizers and inputs have faced disruptions due to conflicts in fertilizer-producing regions and trade actions by major fertilizer producers. The United States’ primary foreign phosphate fertilizer source has experienced such disruptions, adding pressure on the farm economy and domestic food production. These persistent threats necessitate sourcing phosphate fertilizers from diverse foreign suppliers to mitigate the risks to U.S. agricultural food production.
The current domestic production of phosphate fertilizers in the United States cannot fully support its agricultural food production needs after accounting for exports. While the Federal Government is collaborating with the private sector to expand domestic manufacturing capacity, significant supply increases will take time. Immediate measures are needed to ensure U.S. farmers can access sufficient and timely phosphate fertilizers during the planting and growing seasons, securing a stable domestic crop supply and meeting food production demands.
Countries like the Kingdom of Morocco can currently provide phosphate fertilizers to the United States without disruption. It is crucial to immediately facilitate the importation of these fertilizers from Morocco to mitigate risks to U.S. agricultural food production, protect economic and national security, and ensure a stable domestic food supply.
Section 318(a) of the Tariff Act of 1930, as amended (19 U.S.C. 1318(a)), allows the President to declare an emergency due to reasons outlined in section 318(a). This permits the Secretary of the Treasury and the Secretary of Commerce, in line with applicable laws, to authorize duty-free importation of food, clothing, and medical supplies for emergency relief work during such an emergency.
NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, by the authority vested in me by the Constitution and the laws of the United States, including section 318 of the Tariff Act of 1930, as amended, and section 301 of title 3, United States Code, do hereby declare an emergency concerning the availability of sufficient fertilizer supplies to meet agricultural demand. Pursuant to this declaration, I hereby direct the following actions:
(1) To grant additional authority to the Secretary of the Treasury and the Secretary of Commerce to address this emergency, invoking the authority under section 318 and making it available, according to its terms, to both Secretaries. They shall consult with each other when appropriate before exercising this authority.
(2) To alleviate the declared emergency, the Secretary of the Treasury and the Secretary of Commerce, after consulting with the Secretary of Homeland Security, shall take appropriate actions within their authorities under section 318 to permit, until the earlier of 8 months after this proclamation’s date or the emergency’s termination, the duty-free importation of phosphate fertilizers from the Kingdom of Morocco. They may also extend the time for performing any act related to such imports during this period or the emergency.
(3) Pursuant to section 318, the Secretary of the Treasury and the Secretary of Commerce, in consultation with any senior official they consider appropriate, shall monitor and review circumstances related to this emergency. They shall inform the President of any situation that may require further action, including under section 318.
(4) The Secretary of the Treasury or the Secretary of Commerce, as appropriate, shall report to Congress on any action taken under section 318.
(5) Any provision of previous proclamations and Executive Orders that contradicts this proclamation is superseded to the extent of such inconsistency. If any part of this proclamation or its application to any individual or circumstance is held invalid, the remainder remains unaffected.
(6)(a) Nothing in this proclamation shall impair or otherwise affect:
(i) the authority granted by law to an executive department, agency, or its head; or
(ii) the functions of the Director of the Office of Management and Budget regarding budgetary, administrative, or legislative proposals.
(b) This proclamation shall be implemented in accordance with applicable law and subject to the availability of appropriations.
(c) This proclamation does not intend to create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, entities, officers, employees, or agents, or any other person.
