Luigi Mangione is attempting to undermine his federal death penalty case by filing a new motion challenging the charge that could lead to his execution if he is convicted.

Mangione, along with his legal team — Karen Friedman Agnifilo, Jacob Kaplan, and Marc Agnifilo — is requesting the judge dismiss count three of his four-count federal indictment, which alleges murder via firearm use, punishable by death or life imprisonment.

In 2024, federal prosecutors charged Luigi with the alleged murder of Brian Thompson, the CEO of UnitedHealthCare, occurring on a street in Midtown Manhattan. He has also faced charges from New York state for the same murder along with additional serious crimes.

In their latest federal motion, Luigi and his attorneys seek to have count four — accused of using a firearm with a silencer in a violent crime, which could lead to a life sentence — thrown out as well.

Luigi and his defense team also want the court to prevent federal prosecutors from presenting his remarks made during law enforcement’s 2024 arrest at a McDonald’s in Altoona, Pennsylvania, where police discovered a backpack containing a firearm and ammunition.

Furthermore, Luigi’s legal representatives argue that the backpack and its items should be deemed inadmissible in court, citing the absence of Miranda Rights advisement and lack of a search warrant.

In a motion filed in September, Luigi requested the judge to dismiss his indictment, calling it “unconstitutional” and claiming repeated violations of his rights by the NYPD and federal authorities aimed at imposing a death penalty charge against him.
