By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq.), section 604 of the Trade Act of 1974, as amended (19 U.S.C. 2483), and section 301 of title 3, United States Code, it is hereby ordered:

Section 1. Background. In Executive Order 14257 dated April 2, 2025, titled “Regulating Imports With a Reciprocal Tariff To Rectify Trade Practices That Contribute to Large and Persistent Annual United States Goods Trade Deficits,” I identified the significant and ongoing U.S. goods trade deficits as an extraordinary threat to our national security and economy, largely stemming from external sources. Consequently, I declared a national emergency to address this issue, implementing certain ad valorem duties that I deemed necessary and appropriate. Annex II of Executive Order 14257 outlines specific goods exempt from these duties.

Subsequently, in Executive Order 14346 on September 5, 2025, I refined the range of products affected by the reciprocal tariff established in Executive Order 14257, issuing an updated version of Annex II.

Having received further insights and recommendations from officials monitoring the emergency declared in Executive Order 14257, I have undertaken a thorough review. This evaluation considered ongoing negotiations with various trading partners, domestic demand for certain products, and the capacity of our industries. Based on this comprehensive information, I have concluded that it is necessary to further revise the list of products subject to the reciprocal tariff from Executive Order 14257, specifically exempting certain agricultural products. The updated Annex II to Executive Order 14257 and the Annex to Executive Order 14346, titled “Potential Tariff Adjustments for Aligned Partners,” are attached to this order and will take effect for goods consumed or withdrawn from warehouses on or after 12:01 a.m. Eastern Standard Time on November 13, 2025. I believe these modifications are essential to address the national emergency declared in Executive Order 14257.

Sec. 2. Updating Scope of Duties Globally. The Harmonized Tariff Schedule of the United States will be amended as specified in Annex I of this order. These changes will come into effect for goods consumed or withdrawn from warehouses starting at 12:01 a.m. Eastern Standard Time on November 13, 2025. Should this order necessitate refunds for duties collected, these will be processed in accordance with applicable laws and the standard procedures of U.S. Customs and Border Protection.

Sec. 3. Implementation. (a) The Secretary of Commerce and the United States Trade Representative will continue monitoring the situation related to the emergency declared in Executive Order 14257 and will engage in regular consultations with any senior officials they deem necessary. They will promptly inform me of any developments that may warrant further presidential action.

(b) In line with applicable laws, the Secretary of Commerce, the Secretary of Homeland Security, and the United States Trade Representative are empowered to undertake necessary actions, including the establishment of rules, regulations, or guidance, utilizing all presidential powers, including those conferred by IEEPA, to implement this order. These officials may redelegate functions within their respective departments or agencies. All executive departments and agencies are directed to take appropriate measures within their authority to enforce this order.

Sec. 4. Severability. If any clause of this order, or its application to any individual or circumstance, is deemed invalid, the remaining provisions and their applications to other individuals or circumstances will not be affected.

Sec. 5. General Provisions. (a) This order does not diminish or otherwise affect:

(i) the authority granted by law to any executive department or agency, or its head; or

(ii) the functions of the Director of the Office of Management and Budget concerning budgetary, administrative, or legislative proposals.

(b) This order will be implemented in accordance with applicable law and subject to the availability of appropriations.

(c) This order does not confer any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

(d) The costs associated with the publication of this order will be covered by the United States Trade Representative.
