Just when we thought that Brazilian Supreme Court Justice Alexandre de Moraes had reached the pinnacle of judicial overreach, he surprises us yet again with a new low in his relentless campaign against former President Jair Bolsonaro.
On April 23, Bolsonaro was served a subpoena regarding his alleged role in an ‘attempted coup d’état’—a charge that is as nebulous as it is contentious. The document was handed to him by a court officer while he lay in a hospital bed in the Intensive Care Unit (ICU) of DF Star hospital in Brasília, where he has been recovering since undergoing a 12-hour surgery on April 12.

According to Conexão Política, the delivery of the subpoena was sanctioned by the Supreme Court prior to Bolsonaro’s medical discharge. The timing is particularly noteworthy, as it followed Bolsonaro’s live broadcast from the hospital, indicating a somewhat theatrical flair to the proceedings.
The document officially informs Bolsonaro of the initiation of criminal proceedings against him concerning alleged actions that purportedly aimed to undermine the integrity of the electoral process following the 2022 elections. Notably, other defendants in the so-called “core 1” of the case were already notified as early as April 11-15, shortly after the Supreme Court’s First Panel accepted the charges put forth by the Attorney General’s Office.
